中文文摘 经济分析法学是运用经济学的理论、观点和方法来分析法律问题的新兴法律学科。它以新制度经济学，尤其是罗纳德·科斯的交易费用和社会成本理论为基石。以规范分析、实证分析和公共选择分析为具体的方法论。追求效益宗旨，以新的视角对法律进行的审视，带来了法学研究中的革新。这种理论在我国引起了强烈的反响。近年来，有许多著作提及，但对此作系统、深入研究的不多，尤其是对立法的法律经济学研究则更为鲜见。基于这种状况，作者尝试对我国的立法进行经济分析，以期使此研究进一步深化。本文根据研究的需要分为三个部分：前言、正文、结束语。前言部分旨在阐明作为一种法哲学的经济分析法学的理论宗旨、价值取向和本文的立足点。正文分为四个方面：一、分析了我国的立法现状及其原因，进行经济分析的必要性和立法发展的趋势。二、进行立法的供求分析。以马克思主义唯物史观为指导，阐明社会需求是法律供给的现实根据。三、对立法的成本效益分析。由于立法需要成本，如何减少立法成本，提高立法效益是本文的核心问题。其中，涉及立法价值取向的转换。四、阐述了立法与制度创新的问题，对立法进行了制度上的分析。在结束语中，指出本文是以马克思主义唯物史观为指导，以西方经济分析法学的理论为纲目，针对我国的立法制度所作的初步探讨。
英文文摘 Economic Analysis Jurisprudence is a new and developing subject of law, which analyses the theory of law through applying the theory, point of view and analytic tools of economics. It''s based on the new system economics theoretically, especially the theory of trading cost and social cost by Lonard Coase. Also formal analysis, positive analysis and analysis of public choice are it''s methodology. It gazes at jurisprudence in a new visual angle, in addition to conduct the reform in researching of jurisprudence. The idea influence the law circle much in China and many theories concerned with it recently., but it is rare to discuss it systemically and deeply, especially to the research of the Economics of Law in legislation. Therefore, the paper is dedicated to expound the problem initially so as to promoting the researching. The content is divided into three parts, that is preface, text and epilogue. Preface : relate to the theoretical aim, the direction of value and theoretical of Economic Analysis Jurisprudence , also main point of the paper. Text: all together includes four parts. Part 1. involve the present state and developing tendency of legislation. Part 2. relate to the analysis of supplying and requirement. The dissertation is guided by Marxist materialism and raises the social requirement is the basis of law supplying. Part 3. relate to the analysis of cost and benefit in legislation. It is the core of the part to reduce cost and improve benefit which involves the transformation of the valuable direction of legislation. Part 4. Involve making the innovations of legislation and system, while relate to the systemic analysis in legislation. Epilogue. It expound, combined with the state of legislation, legislative system which is guided by Marxist materialism, and outlined by West Economic Analysis Jurisprudence.
